Tfue's contract has allegedly leaked to the public. It includes a non-compete clause, confidentiality agreement, and a troubling split in favor of FaZe Clan.

There has been a lot of talk about the lawsuit going on between Turner "Tfue" Tenney and his organization FaZe Clan.

Tenney released a statement last night on YouTube, calling for FaZe clan to release his contract to the public.

FaZe Clan owner Banks stated that the organization planned to release the contract, but never followed through.

The Blast was able to obtain a copy of the alleged contract through a source and released it themselves.

The Contract

The first area of the contract that Tfue has a problem with is the term. The contract states that:

“the initial Term of this Agreement shall be six (6) months from the Effective Date (“Term”). At the end of the Term, and notwithstanding anything to the contrary set forth in this Agreement (including the T&Cs), this Agreement shall be automatically extended for an additional thirty-six (36) months, provided the following conditions have been met Play on the Team, which includes participating in tournaments and training sessions with the Team and representing the Team, including at events arranged by Company or where Company decides to participate, and provide publicity and promotional services as required by Company”

Essentially, after the first six months, Tenney was locked in for another two and a half years.

Exclusivity

The contract also contains an exclusivity clause that allows FaZe to match any offer another organization makes within a given period. Tenney must also provide FaZe with the name of the organization that is offering him the deal.

“Gamer receives an offer from another ‘Fortnite’ team to join such team upon lawful termination of the Agreement by Gamer (“Offer”), Gamer shall be obligated to provide the Offer to Company and the identity of the party providing the Offer, and Company shall have the right to match such Offer during a period of fifteen (15) business days following Company’s actual receipt of the Offer (the “Matching Right”). If Company elects to exercise the Matching Right, Company shall inform Gamer within said fifteen (15) business day period, and Company shall, automatically have exclusive rights to Gamer’s services on the same terms as the Offer, as supplemented by all of the terms and conditions of the Agreement.”

This is on the of the areas where Tenney and his lawyer believe he has a legal leg to stand on. According to The Blast, California regularly regects non-compete clauses like this one as "unfair business practices."

Confidentiality

As both Tfue and Cloakzy have stated, they're not allowed to disclose their contract, either. According to the contract, Tfue could receive a fine of up to 125% of his monthly pay.

Termination

There's another clause in the contract that includes termination of the contract. If FaZe wants to terminate Tenney, they can effectively sideline him from all public gaming for six months.

“In the event of termination for a Gamer Material Breach, Gamer shall be prohibited from playing video games publicly (on-line or in live tournaments) or professionally for a period of six (6) months from the effective date of such termination."

Earnings

Now, we get onto the meat and potatoes of the contract, and the part where Tfue and his camp are the most unhappy.

According to the letter of the contract, Tfue receives a 50-50 split for all appearance fees, brand deals brought by himself, and in-game sticker (creator code)/merchandise. Tenney will take home 80% of his tournament winnings and only 20% of the brand deals brought by FaZe Clan.

FaZe Clan owner Banks has said that FaZe has only collected $60,000 from Tenney, which is probably true. The issue lies in the word "collected." If they wanted to, Faze could take their cut for millions of dollars at any time.

Sure, Banks and FaZe Clan can say that they never intended to claim this money, but they can still legally do so.
